Recently, Avalon recovered $2.1 million on a California construction case, despite onerous anti-subrogation case law.
In April 2018, an insured employee was severely injured when he fell several stories at a California construction site. SUNZ was the workers compensation carrier which provided benefits to the injured worker and his family.
As part of Avalon’s unique “Day One” approach, it retained industry-leading SIU (Special Investigative Unit) affiliate WatchPoint, and during its investigation a “smoking gun” was uncovered against key project contractors. This became a leverage opportunity that would later become critical within the litigation discovery process.
Avalon became an active intervening party to the personal injury lawsuit filed by the injured worker and during this litigation, Avalon leveraged its investigative evidence, which ultimately resulted in the recent $2.1 million subrogation recovery for SUNZ and its client.
